Creator Responsibility Terms

Unless a giveaway is clearly marked as Giviways-sponsored or fulfilled by Giviways, the creator who publishes the giveaway is the sponsor and prize provider for that giveaway.

The creator remains responsible for the giveaway, the prize, the rules, and the outcome of the promotion.

You are responsible for writing, publishing, and following the giveaway's official rules.

Creators may not require any paid action as a condition of entry unless Giviways expressly approves that requirement in advance.

You may not offer prizes that are illegal, unsafe, age-restricted, counterfeit, stolen, misleading, infringing, unavailable, or prohibited by Giviways policies.

Giviways may maintain and update a list of prohibited or restricted prize categories at any time.

You are responsible for delivering the prize to the winner and for following the delivery timing stated in your giveaway rules.

You must make sure prize details, restrictions, and any delivery requirements are accurate before the giveaway is published.

The creator is responsible for determining and handling any tax reporting, withholding, forms, customs duties, VAT, import fees, or other governmental obligations related to the prize, unless Giviways expressly agrees otherwise in writing.

You agree to cooperate with Giviways in verifying winner eligibility, investigating suspicious activity, resolving disputes, and confirming prize delivery.

You must not deliver a prize to a person Giviways has disqualified, flagged, or instructed you not to fulfill.

Giviways may require proof of prize fulfillment, including tracking information, delivery confirmation, screenshots, redemption confirmation, signed acknowledgement, or other evidence reasonably requested by Giviways.

Prize proof review does not make Giviways responsible for prize delivery or for the quality, safety, legality, or availability of the prize.

Giviways may reject, pause, hide, remove, cancel, investigate, or restrict any giveaway if Giviways believes that the giveaway, prize, creator, entry activity, or related conduct may be fraudulent, misleading, harmful, illegal, abusive, or inconsistent with Giviways policies.

Giviways may request additional information, suspend creator privileges, remove entries, disqualify suspicious activity, block payments or credits where applicable, or ban creators who misuse the platform.

You agree to defend, indemnify, and hold harmless Giviways and its owners, officers, employees, contractors, partners, and affiliates from any claims, losses, damages, penalties, costs, or expenses arising from your giveaway, prize, rules, breach of these terms, failure to deliver a prize, violation of law, or violation of third-party platform rules.

If Giviways incurs costs, refunds, chargebacks, credits, penalties, legal expenses, support costs, or replacement-prize costs because of your giveaway, your conduct, or your failure to fulfill a prize, Giviways may seek reimbursement from you and may offset such amounts against any amounts owed to you where permitted by law.

Using Giviways to create, promote, manage, or verify a giveaway does not transfer your legal or practical responsibilities as sponsor and prize provider to Giviways.

Giviways provides platform tools for giveaway creation, entry collection, verification, winner selection, fraud prevention, and related services.

Unless expressly stated otherwise, Giviways does not provide, guarantee, or deliver creator-sponsored prizes.

By publishing a giveaway, you confirm that you have read, understood, and accepted these Creator Responsibility Terms.
