Giviways Terms of Use

By creating an account, browsing the site, entering a giveaway, creating a giveaway, connecting a third-party platform, or otherwise using Giviways, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

If you use Giviways on behalf of a company, brand, team, or other organization, you represent that you have authority to bind that organization to these Terms.

You must be old enough to form a binding contract in your jurisdiction to use Giviways. If you are under the age of majority where you live, you may only use the Service where permitted by law and, if required, with parental or guardian consent.

You agree to provide accurate, current, and complete information when creating or maintaining your account. You are responsible for keeping your login credentials secure and for all activity that occurs through your account.

We may require profile completion, identity signals, age information, or other account information to use certain features or to comply with legal, safety, or platform requirements. We may refuse, suspend, limit, or remove accounts that appear false, abusive, risky, incomplete, restricted, or associated with fraud or policy violations.

Giviways is a giveaway platform built for gamers, viewers, streamers, and content creators.

We help creators run giveaways, measure participation, and connect with their communities through permitted participation methods described in each giveaway's rules. Some features may involve third-party platforms, but only where supported by those platforms' rules and our current feature settings.

We may also provide analytics, campaign tools, eligibility checks, fraud-prevention signals, participation records, and other features that help creators administer giveaways. These tools are provided for convenience and administration only and do not guarantee any third-party platform outcome.

Giviways is not a gambling, betting, lottery, or casino platform.

Users do not pay Giviways for giveaway entries. Creator payments are for campaign tools, platform access, analytics, giveaway promotion features, or related service functionality, not for selling entries to users.

Giviways is intended to support lawful promotional giveaways, creator campaigns, and community engagement. Creators remain responsible for ensuring that their giveaways are structured and operated in a lawful way.

If you create or manage a giveaway, you are solely responsible for the giveaway and all associated rules, content, eligibility criteria, prize details, timelines, disclosures, and fulfillment.

Each giveaway must have official giveaway rules that are accurate, complete, visible, and lawful. Your rules should clearly describe at least the prize or prizes, eligibility requirements, geographic or age restrictions, entry methods, entry deadlines, winner selection method, winner notification process, prize delivery details, disqualification conditions, and any platform-specific requirements.

You represent and warrant that you have the right to offer the prize you advertise, your giveaway complies with applicable laws and regulations, your giveaway complies with the rules of any third-party platform involved, your rules are not misleading, the prize description is truthful and matches what you will provide, and you will honor the giveaway as announced unless a lawful and clearly disclosed change is required.

Giviways does not provide legal advice. Creators are responsible for consulting their own legal advisors before running giveaways where needed.

Giviways is free for users to browse and enter giveaways.

Users may be asked to complete participation methods described in the giveaway rules, where those methods are permitted by applicable law and by the rules of any third-party platform involved. Some participation methods may occur on third-party platforms and may be subject to those platforms' own terms, availability, and restrictions.

Users are responsible for complying with the rules of any platform they use in connection with a giveaway. Any internet, device, carrier, or third-party costs incurred while using those services are the user's responsibility.

Giviways may offer free-entry features, weekly entry allowances, daily check-in entries, and similar participation features. Those features may change or end at any time.

Giveaways are void where prohibited by law.

Giviways may make entries available through normal entry, permitted participation methods, referral features, weekly entry allowances, promotions, or other methods described in the giveaway rules.

Users may be limited in how many entries they can use per day, per giveaway, or through specific participation methods. Current limits are shown in the product, checkout flow, or giveaway rules and may change from time to time.

Referral rewards are governed by the separate referral reward program described below and do not create an entry cap.

Daily check-in entries are additional free entries that let users participate in more giveaways, subject to the limits and rules shown in the product.

Entries are not money, currency, stored value, account credit, property, or a cash-equivalent reward. Entries have no cash value, cannot be sold, transferred, withdrawn, redeemed for money, exchanged, or refunded, and only provide a chance to participate in a giveaway according to the applicable giveaway rules. Having entries or using entries does not guarantee that a user will win any prize.

Giviways may change entry allowances, pricing, or similar campaign terms going forward, and the giveaway rules shown at the time control how entries are earned and counted.

Winners are selected randomly from eligible entries. More entries increase your chances but do not guarantee winning.

Giviways is responsible for the automated draw and winner notification flow described in the giveaway rules.

Where permitted and technically supported, Giviways may use connected third-party platforms or account integrations for eligibility checks, creator onboarding, fraud prevention, or participation administration. Availability depends on the applicable platform's rules, APIs, permissions, user account status, and current feature settings. Some platform-related features may be delayed, limited, unavailable, or removed if a platform does not permit or support them.

Giviways may also provide analytics, campaign insights, and performance metrics. These are informational tools only and are not a guarantee of future growth, reach, sales, community activity, conversion, or campaign success.

We may require creators to provide prize proof, receipts, screenshots, shipping confirmation, redemption instructions, ownership evidence, or other supporting documentation before or after a giveaway is published.

We may also review prize details, prize images, delivery terms, or campaign materials if needed to verify that the giveaway is real, lawful, and not misleading. If we cannot verify a prize or campaign when required, we may pause, reject, or remove the giveaway.

Creators are responsible for setting age, country, residency, and other eligibility restrictions where required by law, platform rules, or the nature of the prize.

Giviways may restrict access to certain giveaways based on location, age, legal requirements, platform rules, or operational concerns.

Users are responsible for ensuring that they are eligible to enter a giveaway under the applicable rules and laws.

To determine eligibility for region-restricted giveaways and to prevent abuse of those restrictions, we may limit how often you can change your declared country, including a minimum waiting period between changes and a maximum number of changes allowed per year.

Giviways offers optional creator subscription plans. Plan benefits, monthly giveaway allowances, pricing is shown at checkout or on the pricing page and may change according to the plan terms displayed at the time of purchase. Single Giveaway purchases are a separate one-time purchase that let you publish one giveaway beyond your plan's monthly allowance, priced and capped as shown on the Single Giveaway pricing page for eligible creators. Either option still follows the maximum giveaway duration allowed by your current plan.

Publishing a giveaway consumes one unit from the current monthly allowance. It does not draw from a wallet balance, budget hold, or top-up system.

Boost and Mega Boost are separate one-time purchases. They are not part of a subscription allowance and do not change the allowance included in a plan.

Referral rewards are separate from subscription allowances and Boost inventory and are described in the Referral Rewards section below.

If a payment fails, is reversed, is disputed, cannot be authorized, or is later charged back, we may pause, suspend, reject, or limit the related giveaway or account features.

Unless required by law or expressly stated in a specific written Giviways policy, fees, credits, and completed purchases are nonrefundable.

Boost and Mega Boost are promotional one-time purchases that can highlight a giveaway. They are separate from subscription plans and monthly allowance.

We may offer discounts, Single Giveaway passes, and similar promotional offers from time to time. These offers are promotional only, may be limited to certain creators, campaigns, or time periods, and may be changed, paused, or ended by us at any time.

Unless we clearly state otherwise in writing, promotional offers do not stack with one another and do not stack with other discounts, credits, or promotions. If more than one promotion could apply, we may choose which one applies or apply the most beneficial eligible offer at our discretion.

Promotional rewards are not redeemable for cash, withdrawal, or transfer unless we explicitly say so in writing.

When a referred creator makes their first qualifying paid subscription payment and clears the review period, the referrer receives one Standard Single Giveaway pass, subject to the referral program rules. The referred creator does not receive a referral reward.

Referral rewards are Single Giveaway passes, not cash or subscription credit. They are separate from monthly giveaway allowances and Boost inventory, and they do not increase the monthly allowance.

Referral passes expire 90 days after they are granted and are limited to five successful referral rewards per referrer per calendar month.

Refunds, chargebacks, payment disputes, or a failed eligibility review can reverse a pending referral reward or revoke an unused referral pass.

Giveaways or features involving YouTube, Twitch, Discord, Instagram, Facebook, TikTok, X, or any other third-party platform must comply with that platform's rules. We may disable, limit, or replace any platform-related feature if we believe it may conflict with a platform's rules, API policies, review requirements, or enforcement expectations.

Unless clearly stated otherwise in writing by the applicable platform, giveaways on Giviways are not sponsored, endorsed, administered by, or associated with YouTube, Google, Twitch, Discord, Instagram, Facebook, TikTok, X, or any other third-party platform.

We do not control third-party platforms and are not responsible for their availability, policy changes, outages, login issues, data loss, API changes, enforcement actions, or account restrictions. If a third-party platform changes how it works, we may need to adjust or limit related Giviways features.

You are responsible for maintaining your own accounts with third-party services and for following their terms and policies.

You may not use Giviways to run, promote, or support abusive, deceptive, unlawful, fraudulent, or misleading giveaways or campaigns.

Without limiting the foregoing, you may not create fake giveaways or giveaways with no real intention of awarding the advertised prize, use bots or fake accounts to generate entries or artificial activity, manipulate winner selection or campaign metrics, use prize images or branding without permission, impersonate another person or organization, encourage users to violate the terms of a third-party platform, offer incentives in a way prohibited by a third-party platform's rules, or otherwise use the Service in a way that harms users, creators, partners, or the platform.

We may review campaigns before or after launch and may reject, remove, or limit any giveaway that we believe violates these Terms or creates unacceptable risk.

Users may upload profile images, usernames, comments, links, messages, or other content. Creators may upload giveaway descriptions, prize images, campaign media, and other content.

You are responsible for ensuring that any content you submit is lawful, accurate, and does not violate the rights of others. You may not upload content that is obscene, abusive, infringing, misleading, defamatory, or otherwise inappropriate.

We may remove, limit, refuse, or replace any content that we believe is inappropriate, unsafe, infringing, misleading, abusive, or otherwise inconsistent with these Terms or with the Service.

The creator or campaign owner is solely responsible for delivering the prize, arranging shipping if needed, paying applicable taxes or duties, and handling any prize-related requirements or restrictions.

Unless we expressly state otherwise in writing, Giviways is not the sponsor, manufacturer, seller, shipper, or guarantor of any prize.

If a prize becomes unavailable, delayed, or disputed, the creator is responsible for resolving the situation in a lawful and fair way.

Livestream giveaways may be available to eligible creators, depending on feature availability and platform support.

Livestream giveaways remain subject to the rules of the third-party platforms involved and to the giveaway rules shown at the time.

If a livestream feature is unavailable, changed, or discontinued, we may limit or remove related functionality without notice where allowed by law.

Giviways and its design, software, branding, text, logos, graphics, and other platform materials are owned by us or our licensors and are protected by intellectual property laws.

You retain ownership of the content you submit to the Service, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, process, and transmit that content as needed to operate the Service, administer giveaways, display campaigns, provide analytics, and support related features.

You may not copy, modify, reverse engineer, decompile, scrape, or exploit any part of the Service except as allowed by law or by our written permission.

Our collection and use of personal information are described in our Privacy Policy.

By using Giviways, you agree that we may collect, use, store, and share data as described in that policy and as needed to operate the Service. This may include account information, profile details, giveaway activity, entry records, eligibility or fraud-prevention signals, analytics, billing data, support messages, security logs, and data associated with connected third-party accounts.

You may request full account deletion through the deletion flow we provide. Disconnecting a connected platform or unlinking a social account is separate from full deletion.

When an account is deleted, we may require confirmation and may delay or block deletion while active giveaways, unresolved creator-side obligations, or unused spendable credit remain.

If full deletion is completed, any remaining credit may be permanently removed and cannot be recovered, withdrawn, transferred, or converted to cash. Some data may still be retained for legal, payment, security, fraud-prevention, accounting, audit, or operational reasons, or where retention is required by law.

Deleted accounts may also leave behind records that are necessary to preserve giveaway integrity, resolve disputes, complete reporting, or meet platform obligations, and backups or operational records may take time to remove.

Giviways is provided on an 'as is' and 'as available' basis, to the fullest extent permitted by law. We do not promise that the Service will be uninterrupted, secure, error-free, or free of defects.

We do not guarantee that any giveaway will produce a particular result, that any eligibility or participation check will always succeed, that analytics will always be complete or exact, or that any third-party platform will remain available, unchanged, or supportive of a particular feature.

To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these Terms.

To the fullest extent permitted by law, Giviways and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or business opportunities.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

We may update these Terms from time to time. If we do, we may post the updated version on the site and update the effective date above. Continued use of Giviways after the updated Terms take effect means you accept the new Terms.

If a change is material, we may also provide additional notice where required by law.

These Terms are governed by the laws of Cyprus, without regard to conflict-of-law rules, unless your local consumer law requires otherwise.

Any dispute that cannot be resolved informally may be brought in the courts located in Cyprus, unless your local law requires a different forum. Before filing a claim, you agree to contact us and give us a reasonable opportunity to resolve the issue informally.

If any part of these Terms is found unenforceable, the rest of the Terms will remain in effect.
